As part of the its mandate to monitor and enforce compliance to the terms and conditions stipulated in the Health and Safety Manual of the Electrcity Industry, in addition to the provisions of the Grid & Distribution Codes, the Commission hereby publishes these reports

PUBLIC NOTICE

The Nigerian Electricity Regulatory Commission (NERC) is empowered by its enabling Act-  Electric Power Sector Reform (EPSR) Act 2005 to ensure that electricity is generated, transmitted and distributed in the country without threat to health and safety of the environment, workers and consumers alike.
It is in fulfillment of this mandate that the Commission launched the Health and Safety Manual for the electricity industry. As part of the Commission’s mandate to monitor and enforce compliance to the terms and conditions stipulated in the Health and Safety Manual, the health and safety record for the industry from July and September 2009 is hereby published

In addition, the provisions of section (81) subsection (2)(3) of the EPSR Act 2005, the Grid and Distribution codes are also very clear and specific on performance measurement and evaluation. Appendices (3)(4) of the Grid code provide for some system reliability performance measurement indices and safety precautions respectively; While sections 4&6 of the Distribution code also provide for distribution system reliability performance measurement and safety precautions. These and other provisions of the Grid and Distribution codes empower the commission to measure and evaluate performances of the operators.
In view of the above, the Commission has agreed with the Electricity Industry Operators Key Performance Indicators (KPIs), Reporting Templates and Reporting Frequencies (monthly, quarterly and annually). However, some of the Operators have been responsible enough to be up to date with their reports on the KPIs, while others have failed to do so.
It is important to note that it is only when quality and timely rendition of data/information is made by the operators that the Commission will be able to make meaningful assessment/analysis of industry’s Performance and production of Scorecard.
The Commission is beginning to initiate the process of sanctioning erring operators who did not see reasons with the Commission’s initiatives and understanding of the magnitude of the power sector problems.
This publication seeks to call on all defaulting Operators to comply with the reporting obligations on KPIs. The Electric Power Sector Reform Act 2005 provides for enforcement of penalties for non-compliance with the reporting obligation requirements.
